Chapter I: Regulations on the My Points membership program

Article 1: Purpose

- Members accumulate points through shopping for products at chains participating in the My Points program and can use accumulated accounts to purchase products and services at stores participating in the program. submit.

Article 2: Definition

- Members are customers who accept the program terms and register information to become members of the My Points program, collectively known as members.

- Member policies are care policies developed by My Points exclusively for members, and are collectively referred to as policies.

- Member account is the member's point accumulation account. Each member only has 01 (one) account, the account will be verified based on ID card/CCCD/Passport.

- Points are the unit of calculation for member spending transactions accumulated in the account.

- Cumulative spending is the amount of money a member has purchased products or used services at the chains Mykingdom, Hobiverse, ZuZu, Clever Collection during the 12-month ranking period according to My Points regulations and is used to consider the Membership Rank. Vienna.

- Membership class is the rank at which a member is recognized based on the number of ranking points the member has accumulated according to regulations. There are 03 (three) membership levels: Silver Class, Gold Class and Diamond Class. Depending on total member spending at My Points and partner brands, the Membership Level may change.

- Accumulated Points are member points accumulated at a rate specified and announced by My Points when members purchase products or services from My Points and members can use these points to buy products or use them. Article 3: Membership Policy

Preferential policies for members according to the following mechanism:

✔ Accumulated spending: After purchasing products or using services at Mykingdom, Hobiverse, ZuZu, Clever Collection chains, members will accumulate according to regulations and will rely on ranking points to determine Membership Class and preferential mechanism members will receive (rate will be accumulated after VAT, after deducting promotional incentives and after deducting accumulated points used)

✔ Accumulate and use Accumulated Points: Members can use to buy products or use services at chains participating in the My Points program, according to My Points regulations.

✔ Promotional application program (For all members or by membership class): Members can use incentives proposed by My Points and announced on media channels decided by My Points.

Article 4: Subjects and conditions for membership registration

4.1 Subjects

- Every customer aged 18 and over can become a member of My Points. Customers will register for membership at Mykingdom, Hobiverse, ZuZu, Clever Collection stores or on the Mykingdom website by filling in the required information. My Points has stipulated and agreed to the terms of consent on collection and use of personal information.

- Members are not allowed to convert or transfer their membership to a third party and cannot be used as security.

4.2 Registration conditions

- Customers register for a free membership account at Mykingdom, Hobiverse, ZuZu, Clever Collection stores and Mykingdom website.

- Customers must provide correct & complete personal information (Phone number, full name and full name are required information that My Points requires when registering an account to become a member)

- Each individual can only create one account. New members will receive a confirmation message via registered phone number to successfully activate their account.

Article 5: Scope of use:

Article 6: Use and Management of member accounts

- Members must provide their account information to accumulate before issuing payment invoices.

- Member accounts are not allowed to convert, transfer or authorize a third party to use or act as a security asset without the prior consent of My Points.

- When members use incentives, accumulated points, services or change personal information, My Points has the right to require members to present their identity card for confirmation.

- My Points is not responsible for any damage to members due to members violating regulations, or due to carelessness in managing member accounts.

- If your member account is lost or suspected of being stolen, please immediately notify My Points for assistance in processing. My Points will not be responsible for any loss that occurs before the member has notified and the problem has been recorded by My Points on the system.

Article 7: Criteria for considering Membership Class

7.1. Ranking cycle:

- Member's ranking cycle is 12 months from July 7, 2022.

- The start of the ranking cycle is calculated on July 7 every year.

For example:

- Members who register on May 1, 2023 will be considered for Membership Rank on July 7, 2023 based on cumulative spending from May 1, 2023 to July 6, 2023.

- For members who register on June 15, 2022, the ranking cycle will be from July 7, 2022 to July 6, 2023. During this time, how much the member has accumulated and spent will be subject to the corresponding limit. Membership Rank will be determined based on Accumulated Spending.

7.2. Classification regulations

- After purchasing products or using services at retail chains participating in the My Points program, members will accumulate according to regulations.

- The total minimum accumulated spend in each qualifying cycle for each Membership Class is as follows:

7.3. Promote, maintain, and demote

- If the member does not meet the maintenance requirements, the Membership Rank will be lowered according to each corresponding ranking condition.

8.1.1. Form of point accumulation

- Accumulated points will take effect 3 days after the customer purchases the order.

- Accumulated Points will be accumulated according to the preferential level of each class on the total invoice value paid into the member account (after V.AT, after deducting accumulated points used and after deducting incentives promotion)

- Unlimited number of accumulations.

- 1 point is equivalent to 1 VND when making payment. (1 point = 1 dong)

- Silver member first spending: 500,000 VND - accumulated 1% = 5,000 points (after 3 days).

- Member continues to spend the second time: 560,000 VND - accumulated 1% = 5,600 points (after 3 days).

- Member continues to spend the 3rd time: 5,000,000 VND - accumulated 1% = 50,000 points (after 3 days)

- Total Points Accumulated: 60,600 points.

- Accumulated points are valid until March 31 of the following year.

8.1.2. Conditions for applying incentives

- Only applicable to members who come to use directly at the list of stores participating in the My Points program or Mykingdom website (Does not accumulate delivery costs).

- Each member who scans QR for the first time will receive a gift with an expiration date and clearly stated in the message content.

- Each member will receive the following birthday promotion:

+ Register or update 30 days before your birthday.

+ Members can register birthdays for themselves, their children or others (if any), however they can only register a maximum of 2 incentives/member/year.

- Each member who upgrades their rank will receive exclusive gifts according to each rank.

- In case the accumulated portion is subject to taxes or other fees and charges as prescribed by the competent management agency, these taxes, fees or/and charges will be borne by the member.

Article 9: Withdrawal and cancellation/locking of membership.

- Any member, at any time, can request to withdraw membership in writing, phone message or by any other means prescribed by My Points and My Points will support Support to resolve withdrawal of membership at member's request.

My Points reserves the right to cancel/lock membership upon any of the following events:

- Registration information is incorrect/unauthenticated.

- Applying/using the program in contravention of regulations (illegal) or for inappropriate purposes such as accumulating and using accounts incorrectly.

- Members are involved in prohibited cases or are contrary to public order and good customs such as preventing other members from using the My Points website or My Points application or abusing related information. from other websites or violate the obligations specified in this document.

Withdrawal of membership or cancellation/locking of membership according to regulations will take effect on:

- Date the member requests to withdraw membership

- Date the member receives notice of cancellation/lockout of membership

Article 10: Account handling when withdrawing membership

- When a Member requests to withdraw membership, the Member does not use all the accumulated points, all points will automatically expire.

- When the Member is canceled/locked according to regulations, the accumulated points will automatically expire.

Article 11: Change or termination of Membership Policy

- My Points has the right to change the structure and terms of membership policy or terminate the membership policy in one (01) part or terminate the entire program without prior notice, and will notify Members. through any of My Points' media (Website, Zalo OA, ....)

- Members will not be able to enjoy all membership policy incentives after the date My Points has announced and stipulated.

Chapter II: Rules for using My Points member information

Article 12: Collecting member personal information data

- Information collected by My Points members includes:

+ Email

+ Member's gender, member's child, baby's due date (for products for pregnant mothers)

Article 13: Sharing member information with third parties

- This information will be shared with partners when My Points implements contracts and agreements related to the use of member data.

- The third party is responsible for fully implementing the regulations on responsibility for processing personal data in accordance with the Law.

Article 14: Principles of protecting member personal data

- Members' personal data is processed in accordance with the law.

- Members are informed about activities related to the processing of their personal data, unless otherwise provided by law.

- Members' personal data will only be processed for the purposes registered by My Points and declared on personal data processing.

- Members' personal data collected must be appropriate and limited to the scope and purpose to be processed. Personal data may not be bought or sold in any form, unless otherwise prescribed by law.

- Member's personal data is updated and supplemented in accordance with the processing purpose.

- Members' personal data is subject to protection and security measures during processing, including protection against violations of regulations on personal data protection and prevention and control. loss, destruction or damage due to incidents, using technical measures.

- Personal data is only stored for a period of time consistent with the purpose of data processing, unless otherwise prescribed by law.

- My Points shall be responsible for complying with data processing principles and demonstrating its compliance with such data processing principles.

Article 15: Members' rights to data

- Right to know: Members have the right to know about the processing of their personal data, unless otherwise provided by law.

- Right to consent: Members may agree or not consent to the processing of their personal data, except for the cases specified in Article 13 of this Regulation.

- Right of access: Members have access to view, edit or request correction of their personal data, unless otherwise provided by law.

- Right to withdraw consent: Members have the right to withdraw their consent, unless otherwise provided by law.

- Right to delete data: Members can delete or request deletion of their personal data, unless otherwise provided by law.

- Right to restrict data processing

  • Members are required to limit the processing of their personal data, unless otherwise provided by law;
  • Restriction of data processing is carried out within 72 hours after the member's request, with all personal data that the Member requests to be restricted, unless otherwise provided by law.

- Right to provide data: Members may request My Points to provide themselves with their personal data, unless otherwise provided by law.

- Right to object to data processing

  • Members may object to My Points processing their personal data to prevent or limit disclosure of personal data or use for advertising and marketing purposes, unless otherwise provided by law;
  • My Points fulfills member requests within 72 hours of receipt, unless otherwise provided by law.

- Right to complain, denounce and sue: Members have the right to complain, denounce or sue according to the provisions of law.

- Right to request compensation for damages: Members have the right to request compensation for damages according to the provisions of law when violations of regulations on protecting their personal data occur, unless otherwise agreed upon by the parties. other or the law has other provisions.

- Right to self-defense: Members have the right to self-defense according to the provisions of the Civil Code and other relevant laws, or request competent agencies and organizations to implement protection methods. civil rights according to the provisions of the Civil Code.

Article 15: Member's obligations regarding data

Article 16: Member's consent

- Member's consent applies to all activities in the personal data processing process, unless otherwise provided by law.

- A member's consent is only valid when the member is voluntary and clearly knows the following contents:

  • Types of personal data processed;
  • Purpose of processing personal data;
  • Organizations and individuals may process personal data;
  • Rights and obligations of members.

- The member's consent must be expressed clearly and specifically in writing, voice, checking the consent box, consent syntax via text message, selecting consent technical settings or through an action. Other movements demonstrate this.

- The consent must be given for the same purpose. When there are multiple purposes, My Points needs to list the purposes so that members can agree with one or more of the stated purposes.

- The member's consent must be expressed in a format that can be printed, reproduced in writing, including in electronic or verifiable format.

- A member's silence or non-response is not considered consent.

- Members can agree partially or with attached conditions.

- For processing sensitive personal data, members must be informed that the data to be processed is sensitive personal data.

- The member's consent is valid until the member decides otherwise or when a competent state agency requests it in writing.

- In case of dispute, the responsibility of proving the member's consent belongs to My Points.

- Through authorization according to the provisions of the Civil Code, My Points can carry out procedures on behalf of members related to processing members' personal data, unless otherwise prescribed by law.

Article 17: Withdrawal of consent

- Withdrawal of consent does not affect the lawfulness of the data processing that was agreed to before the withdrawal of consent.

- The withdrawal of consent must be expressed in a format that can be printed, reproduced in writing, including in electronic or verifiable format.

- When receiving a data subject's request to withdraw consent, My Points needs to notify the data subject of the consequences and damages that may occur when withdrawing consent.

- After withdrawing consent, My Points must stop and request relevant organizations and individuals to stop processing the data of the data subject who has withdrawn consent.

Article 18: Commitment to collecting personal information and keeping member personal information confidential

- My Points will collect members' personal information from the information provided by the member and the information requested when registering an account to become a member.

- My Points has the right to aggregate information and use it for marketing activities to provide programs to better take care of members.

- Personal information that My Points collects from Members is the identifying information provided by the member in the registration form such as Phone Number, Email, full name, date of birth, birth certificate, and other information. Transaction information that My Points collects when Members use it.

- My Points commits to absolute confidentiality of members' personal information according to the personal information protection policy. The collection and use of each member's information is only carried out with that member's consent, unless otherwise prescribed by law.

My Points does not use, transfer, provide or disclose to any third party the member's personal information without the member's permission or consent, except in the following cases:

- In case minimum information (full name, phone number and email) is required to be disclosed to service providers

- Where personal information is disclosed for statistical, research, or marketing purposes, provided that such information is disclosed in a form from which it is impossible to identify any any particular person; or in case of disclosure of personal information as required by law.

Article 19: Right to adjust members' personal information

- Member:

  • Have access to view and edit your personal data after it has been collected by My Points according to your consent, unless otherwise provided by law;
  • In case direct editing is not possible for technical or other reasons, members have the right to request My Points to edit their personal data.

- My Points edits members' personal data after receiving the individual member's consent as soon as possible or as required by law. In case this cannot be done, notify the member within 72 hours of receiving the request to edit the member's personal data.

- When members have any personal information that needs to be changed, please provide relevant images/documents to My Points for support and My Points will not be responsible for any damages arising due to Member's negligence.

- When receiving information from the member (cancellation or adjustment of information), My Points will process it within seven (07) working days.

Article 20: Storage, deletion, destruction of personal data

- Members have the right to request My Points to delete their personal data in the following cases:

  • Realizing that it is no longer necessary for the purpose of collection, have agreed and accepted the damages that may occur when requesting data deletion;
  • Withdraw consent;
  • Object to the data processing and My Points does not have a legitimate reason for continuing the processing;
  • Personal data is not processed for the agreed purpose or the processing of personal data is in violation of the law;
  • Personal data must be deleted in accordance with the law.

- Data deletion will not apply upon request of the data subject in the following cases:

  • The law does not allow data deletion;
  • Personal data is processed by competent state agencies for the purpose of serving the activities of state agencies in accordance with the law;
  • Personal data has been made public in accordance with the law;
  • Personal data is processed to serve legal requirements, scientific research, and statistics in accordance with the law;
  • In case of emergency in national defense, national security, social order and safety, major disasters, dangerous epidemics; when there is a threat to security and national defense but not to the extent of declaring a state of emergency; preventing and combating riots, terrorism, preventing and combating crime and law violations;
  • Respond to emergency situations that threaten the life, health or safety of data subjects or other individuals.

- In case My Points divides, splits, merges, consolidates, or dissolves, personal data will be transferred in accordance with the law.

- Data deletion is performed within 72 hours after the data subject's request for all personal data collected by My Points, unless otherwise prescribed by law.

- My Points stores personal data in a form appropriate to its operations and has measures to protect personal data in accordance with the law.

- My Points deleted cannot be restored in the following cases:

  • Processing data for improper purposes or for which the purpose of processing personal data agreed to by the data subject has been completed;
  • The storage of personal data is no longer necessary for the operation of My Points;
  • My Points is dissolved or no longer operates in accordance with the law.

- Collected member's birthday information will be stored for as long as the member account is valid. Members who have withdrawn their membership or whose membership has been cancelled, will be deleted and canceled after the time specified by My Points.

- In cases where the law requires, the company is required to retain personal information for a certain period of time for purposes such as identifying details of Members' transactions. My Points has the right to retain collected personal information for a period of time as prescribed by relevant laws.

Article 21: Processing personal data in cases where member consent is not required

- In an emergency, it is necessary to immediately process relevant personal data to protect the life and health of the data subject or other people. My Points bears the burden of proving this case.

- Disclosure of personal data according to the provisions of law.

- Data processing by competent state agencies in case of emergency situations related to national defense, national security, social order and safety, major disasters, dangerous epidemics; when there is a threat to security and national defense but not to the extent of declaring a state of emergency; prevent and combat riots, terrorism, prevent and combat crimes and violations of the law according to the provisions of law.

- To perform the data subject's contractual obligations with relevant agencies, organizations and individuals according to the provisions of law.

- Serving the activities of state agencies as regulated by specialized laws.

Article 22: Processing personal data of people declared missing or dead

- The processing of personal data related to the personal data of a person declared missing or deceased must have the consent of that person's spouse or adult children, in the absence of these people. The consent of the father or mother of the person declared missing or deceased must be obtained.

- If all of the above mentioned people are not present, it is considered that there is no consent.

Article 23: Processing of children's personal data

- Processing of children's personal data is always carried out in accordance with the principle of protecting the rights and in the best interests of children.

- The processing of children's personal data must have the child's consent in case the child is 7 years old or older and has the consent of the father, mother or guardian according to regulations. My Points must verify the age of children before processing their personal data.

- Stop processing children's personal data, irreversibly delete or destroy children's personal data in the event of:

  • Processing data for purposes other than the purpose or for which the purpose of processing personal data agreed to by the data subject has been completed, unless otherwise prescribed by law;
  • The child's father, mother or guardian withdraws consent to the processing of the child's personal data, unless otherwise provided by law;
  • At the request of a competent authority when there is sufficient evidence to prove that the processing of personal data affects the legitimate rights and interests of children, unless otherwise prescribed by law.

Article 24: Protection of personal data in the business of marketing services and introducing advertising products

- Members' personal data collected through Viet Tinh Anh Joint Stock Company's business activities may only be used to provide marketing services and introduce advertising products with the consent of the data subject. Whether.

- The processing of members' personal data to provide marketing services and introduce advertising products must be approved by the member, on the basis that the customer clearly knows the content, method, form, frequency of product introductions.

- Responsible for proving the use of personal data of customers whose products are introduced in accordance with the above regulations.

Article 25: Illegally collecting, transferring, buying, and selling personal data

- My Points must apply personal data protection measures to prevent unauthorized collection of personal data from its systems and service equipment.

- Setting up software systems, technical measures or organizing activities to collect, transfer, buy and sell personal data without the consent of the data subject is a violation of the law.

Article 26: Notice of violation of regulations on personal data protection

- In case a violation of personal data protection regulations is detected, My Points must notify the Ministry of Public Security (Department of Cyber ​​Security and High-Tech Crime Prevention) at least 72 hours later. when a violation occurs. In case of notification after 72 hours, the reason for late notification must be included. The focal point of Viet Tinh Anh Joint Stock Company sending notice of violation to the Ministry of Public Security is the Information Security Department - Head of the Legal Department.

- My Points must notify the contact person of Viet Tinh Anh Joint Stock Company, Mr. Le Quoc Huy - Head of Legal Department as quickly as possible after noticing a violation of regulations on personal data protection.

- Content of notice of violation of regulations on personal data protection:

  • Describe the nature of the violation of personal data protection regulations, including: time, location, behavior, organization, individual, types of personal data and quantity of data involved;
  • Contact details of the employee tasked with data protection or the organization or individual responsible for protecting personal data;
  • Describe the possible consequences and damages of violating personal data protection regulations;
  • Describe the measures put in place to resolve and minimize the harmful effects of violations of personal data protection regulations.

- In case it is not possible to fully notify the above-mentioned contents, notification can be done in batches and stages.

- Head of the Legal Department prepares a record confirming the occurrence of a violation of personal data protection regulations, coordinating with the Ministry of Public Security (Department of Cyber ​​Security and High-Tech Crime Prevention and Control) handle violations.

– The Head of the Legal Department notifies the Ministry of Public Security (Department of Cyber ​​Security and High-Tech Crime Prevention and Control) when detecting the following cases:

  • Detect legal violations of personal data;
  • Personal data is processed for the wrong purpose, not in accordance with the original agreement between the data subject and My Points or in violation of the law;
  • The rights of data subjects are not guaranteed or are not implemented properly;
  • Other cases as prescribed by law.

Article 29: Authorization to handle and manage personal information

- In principle, My Points will perform activities related to the processing and management of personal information collected from Members. In case of necessity, My Points has the right to appoint a third party. carry out all or part of the processing and management of this personal information.

- My Points is responsible for maintaining a security system to protect members' personal information.
